California Proposition 65 Warning
What Proposition 65 is
California’s Safe Drinking Water and Toxic Enforcement Act requires businesses to warn consumers before exposing them to chemicals the state has listed as causing cancer, birth defects or other reproductive harm. Alcoholic beverages are among the exposures covered by a published warning.
The published alcohol warning
WARNING: Drinking distilled spirits, beer, coolers, wine and other alcoholic beverages may increase cancer risk, and, during pregnancy, can cause birth defects. For more information go to www.P65Warnings.ca.gov/alcohol.
That wording is the safe-harbour text published by California’s Office of Environmental Health Hazard Assessment for alcoholic beverages. It is reproduced here for convenience; the label on the bottle and the outer carton carry the notice that legally applies to the product.
Which products carry it
The requirement applies to alcoholic beverages offered for sale in California. Whether a particular bottle carries a printed Proposition 65 notice depends on the producer and the packaging, so read the label on delivery. The operator of this store must confirm its own Proposition 65 obligations before live orders are accepted.
Not a statement about safe limits
A Proposition 65 warning is a disclosure requirement rather than a finding that a product is unsafe at any particular level, and it does not replace the federal government warning. Neither notice should be read as medical advice.
